New Jersey Regulations for Property Sales

Residential property sales refer to the sale and transfer of a home, housing structure, or land intended for human habitation (not commercial or industrial use) from one party to another. Some common examples include single-family homes, townhouses, condos, and small multi-unit residential buildings.

Sellers are required to complete a Seller’s Property Condition Disclosure Statement for every property they sell, as outlined under the New Jersey Consumer Protection Act. The goal is to provide potential buyers with the necessary information they need about the property to make informed decisions about their purchase. The primary disclosures property owners are required to provide before selling include:

  • Flood risk data, including flood risk potential, any past flood damage to the property, and history of flood insurance.

  • Structural or system damage, including any known issues relating to the roof, foundation, electrical systems, plumbing, or HVAC systems.

  • Environmental hazards in the house or on the property, such as the use of lead-based paint or the presence of asbestos or mold.

  • Any unpermitted work that has been conducted or completed on the property, such as any home renovations or exterior constructions (e.g., carport or sheds) that did not have a proper permit.

Without a completed disclosure statement, buyers are not contractually obligated to purchase a property. If you decide to sell a property “as-is,” you will still be required to complete the necessary disclosures. However, you are only legally required to disclose information that you know. Under New Jersey law, sellers do not have to complete a home inspection before selling a property.

If you are looking to sell residential property or are in the middle of a real estate transaction, consult our experienced real estate sales attorneys. We can help you make sure the necessary information is disclosed and guide you through the sales process.
